Petitioner apprehends arrest in a case registered for the offence punishable under sections 127(2), 308(5) and 3(5) of the Bharatiya Nyaya Sanhita, 2023. 3. As per prosecution case, informant had been called by one Subodh Paswan to Dhamauli to deliver money relating to land. Accordingly, informant reached Dhamauli market on 22.7.2025 at about 8.15. Subodh Paswan was talking with informant’s driver Sudhir Kumar. As per address given by Subodh Paswan, the informant along with his driver crossed the railway line and reached near a police where there was small temple. While the informant was sitting near the culvert and his Patna High Court CR. MISC. No.86694 of 2025(6) dt.07-07-2026 2/3 driver was in the car, on the signal of a lady constable, occupants of Dial-112 rushed towards the car and started searching the same. They forcibly took away Rs. 15 lacs kept in a plastic bag on the back seat of the car. Accused persons forced the informant to seat in an Auto. They also took mobile phone of the informant and got them switched off and handed over to the Auto driver. Accused persons told the Auto driver to drop the informant at Bakhtiyarpur and then to hand over the mobile phones. 4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner is a poor labourer engaged in construction activities and he is no way concerned with alleged extortion. Petitioner claims clean antecedent. 5. Learned counsel for the State opposed the prayer for bail. Petitioner’s name has come in this case during course of investigation on the basis of confessional statement of co- accused Rakesh Paswan from whose possession, recovery of 2 SIM in question as well as cash Rs.3.50 lacs has been made. CDR reveals that at the relevant time, petitioner was in touch with other accused persons. Several witnesses have supported involvement of this petitioner in the alleged offence. Patna High Court CR.
