2. The petitioner is seeking a writ of mandamus directing respondent Nos. 2 to 4 to remove the entries in the revenue records in so far as 01 Acre 22 Guntas in Sy. No.206 of Belavadi Village, Kasaba Hobli, Srirangapattana Taluk, Mandya District and to enter name of the petitioner in the land records.
However, learned AGA submits that the petitioner could not have filed a writ petition seeking such directions at the hands of this Court, since remedy is available for the petitioner in terms of Section 136(2) of the Karnataka Land Revenue Act, 1964. Learned AGA submits that the aggrieved person will have to be notified, heard and thereafter a decision can be rendered by the Assistant Commissioner. 3. There is substance in the submission of the learned AGA. Whether or not the petitioner is the owner of the property and whether the revenue entries made in favour of the Department of Public Works is sustainable questions that are all have to be decided by the Assistant Commissioner after issuing notice to the concerned. 4. Accordingly, Writ Petition is disposed of, reserving liberty to the petitioner to approach the Assistant Commissioner

by invoking the appeal provision to question the revenue entries made in favour of the Department of Public Works. 5. If an appeal is filed by the petitioner, the Assistant Commissioner shall consider the same after issuing notice to the other side and shall dispose of the appeal as expeditiously as possible and at any rate, within a period of four months from the date of the appeal that would be filed by the petitioner. Learned AGA is permitted to file memo of appearance within a period of four weeks from today. Sd/- (R DEVDAS) JUDGE
