JUSTICE PARTHIVJYOTI SAIKIA ORDER Date : 03.03.2025 Heard Mr. N.K. Kalita, the learned counsel appearing for the petitioner. Also heard Mr. D.P. Goswami, the learned Additional Public Prosecutor for the State of Assam. 2. This is an application under Section 483 of the BNSS, 2023, whereby the petitioner, Page No.# 2/2 Mukut Ali has prayed for releasing him on bail after he was arrested in connection with Basistha P.S. Case No. 899/2024. 3. One lady/informant has alleged in the FIR that the petitioner assaulted her with a sharp weapon and caused injuries on her neck and chest. She has stated that she refused the proposal of love made by the petitioner and that is the reason why she was attacked. 4. The petitioner stated that he was maintaining relationship with the girl for a long time. They even had some monetary transactions. Rift occurred between them for monetary transactions. 5. The learned counsel for the petitioner submits that because of dispute they had a quarrel and a scuffle in which the woman sustained injuries. 6. Mr. Goswami has pointed out that the injuries sustained by the informant girl was on her neck and the doctors suggested that it was a grievous injury. 7. The petitioner has already spent 80 days in judicial custody. 8. I have considered the submissions made by the learned counsel of both sides. 9. Considering the long period of detention and the circumstances under which the incident took place, the bail application of the petitioner is allowed. 10. It is hereby directed that the petitioner, Mukut Ali, who was arrested in connection with Basistha P.S. Case No. 899/2024, shall be released on bail of ₹20,000/- with a surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Kamrup (M), Guwahati, Assam. With the aforesaid direction, the bail application stands disposed of. The CD shall be returned. JUDGE Comparing Assistant
