JUSTICE MOHAMMAD NAWAZ ORAL ORDER Petitioner is before this Court seeking to quash the criminal proceedings pending against them in C.C.No.442/2024 on the file of the Court of Additional Civil Judge and JMFC, Belthangadi. 2. The above case arise out of Crime No.77/2023 of Venoor Police Station, Dakshina Kannada, registered for - 3 - HC-KAR NC: 2025:KHC:46090 CRL.P No. 14821 of 2025 the offence punishable under Section 5, 7 and 12 of the Karnataka Prevention of Slaughter and Cattle Preservation Act, 2020. 3. It is the case of prosecution that on 08.12.2023 at about 10.15 p.m., the accused was transporting two cattle in an inhumane manner for the purpose of slaughtering, in a pick up vehicle bearing No.KA-13-C- 4395. 4. The PSI of Venoor Police Station registered a suo moto case, based on which the crime was registered against the petitioner and upon investigation chargesheet was filed. 5. As per prosecution, the complainant received a credible information that the accused is illegally transporting the cattle from Hosangadi to Venoor and therefore they went to the spot and intercepted the said vehicle near Venoor Church, Karimanelu Village, - 4 - HC-KAR NC: 2025:KHC:46090 CRL.P No. 14821 of 2025 Belthangady Taluk. The two cattle and the vehicle bearing No.KA-13-C-4395 were seized under a mahazar. 6. As could be seen from the material on record, FIR was registered on 09.12.2023 i.e., after the Police conducted a seizure in this case. Section 154 of Cr.P.C., mandates that upon receiving an information regarding a cognizable offence, the Police must immediately register a FIR before proceeding with an investigation or record the information in the Station House Diary in cases of exigencies. In the instant case, no such procedure has been followed. Further, except the vague allegations that the cattle were being transported in an inhumane manner, it is not stated as to in what manner, the cattle were being transported in the vehicle. Admittedly, there were only two cattle in the pick up vehicle. There is also no material placed to show that the two cattle were being transported to a slaughter house. Vague allegation in that regard is insufficient to proceed against the petitioner. Hence, the following: - 5 - HC-KAR NC: 2025:KHC:46090 CRL.P No. 14821 of 2025 ORDER Petition is allowed. The entire proceedings in C.C.No.442/2024 pending before the Court of Additional Civil Judge and JMFC, Belthangady are quashed. I.A.No.1/2025 is disposed of.
