237 IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH CRM-M-34449-2025 (O&M) DATE OF DECISION : 10.07.2025 MONU .......PETITIONER(s) VERSUS STATE OF HARYANA .....RESPONDENT(s) CORAM: HON'BLE MR. JUSTICE SANDEEP MOUDGIL Present: Mr. Atul Yadav, Advocate for the petitioner(s). Ms. Mayuri Lakhanpal Kalia, DAG, Haryana. *** SANDEEP MOUDGIL, J.(Oral) This petition has been filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 with a prayer for regular bail to the petitioner in F.I.R. 145 dated 15.04.2023 under section 323, 307, 34 and 506 of IPC registered at Police Station, Bilaspur, District Gurugram, pending trial. Custody certificate filed by learned State Counsel is taken on record. The Registry has brought to the attention of this Court that the present petition is, in fact, the second petition filed by the petitioner seeking the grant of regular bail. However, in the prayer clause of the instant petition, the counsel for the petitioner has incorrectly stated that this is the first petition for such relief. This false or inaccurate declaration is a serious matter, as it misleads the Court and creates unnecessary administrative pressure on the Registry and other employees who are responsible for processing and listing matters. Anuradha 2025.07.11 06:35 I attest to the accuracy and integrity of this document CRM-M-34449-2025 (O&M) 2 This Court notes with concern that such a misstatement by the learned counsel is not a mere clerical error but a lapse that affects the integrity of the judicial process. It results in the duplication of work and may cause delays in the adjudication of other matters. The incorrect categorization of the petition compels the Court's staff to process the matter under a mistaken premise, thereby wasting valuable judicial time and resources. In view of the above, and considering the need to uphold procedural discipline and accountability in the judicial system, this ₹ Court deems it appropriate to impose a cost of 10,000/- (Rupees Ten Thousand only) on the petitioner. This cost is directed to be deposited with the Punjab and Haryana High Court Employees’ Welfare Association, as a measure to recognize the additional burden placed on the Registry and to deter such careless or misleading conduct in the future. At this stage, learned counsel for the petitioner prays for withdrawal of the instant case with liberty to file afresh with better particulars. Allowed as prayed for. Dismissed as withdrawn with above said observation and with liberty afore-said.
