A preliminary objection has been raised by Sri N.C. Rajwanshi, learned Senior Counsel appearing on behalf of private respondents. According to him, the order impugned passed in proceedings under Section 144 of U.P. Revenue Code, 2006 is appealable under Section 207 of U.P. Revenue Code, 2006. Sri Sharad Malviya, learned counsel for the petitioners has admitted the fact that against the order impugned, the appeal has already been preferred. Once, the appeal has already been preferred by the petitioner and the same is still pending consideration, the writ petition filed by the petitioners is not maintainable, as two proceedings cannot simultaneously go on.
