The petitioner has been made accused in connection with Khukhra P.S. Case No. 06 of 2021, corresponding to G.R. No.2235 of 2024, S.T. Case No.586 of 2024, for the offence registered under Sections 376(D)/504/506 of the Indian Penal Code, pending in the court of Shri Sanjiv Kumar Verma, learned Additional Sessions Judge-V, Giridih. Petitioner and co-accused persons are alleged to have gang raped the prosecutrix. It was submitted that there is delay in lodging of the F.I.R. Learned A.P.P on behalf of the State has submitted that the husband of the prosecutrix was in custody and as such, he could not file F.I.R within time.
