This Court vide order dated 9.9.2025 has passed the order in following terms :- 1. Shri Krishna Dutt Mishra, learned Standing Counsel, is directed to seek instructions in the matter and apprise the Court as to whether the shop handed over to the petitioner has plaster on the walls and whether a gate has been installed or not. If not, then it be clarified as to how an affidavit has been filed stating that the shop has been constructed and handed over to the petitioner. 2. In case proper instructions are not furnished by the next date, the Court may summon the District Magistrate, Prayagraj. 3. Put up as fresh on 16.09.2025. 2. Sri Rajesh Kumar Pal, learned Standing Counsel, on the basis of instructions received, submits that the authority has not restrained the petitioner from plastering the shop in question or from opening the gate towards the north, which is the original entrance of the shop. It is further submitted that the petitioner is, in fact, attempting to encroach upon the eastern side and is trying to open a gate towards the east, for which he is not authorized, as the petitioner does not have any existing doorway or right on the eastern side. Paragraph Nos. 6 and 8 of the instructions filed on behalf of the State is reproduced herein below :- "6. िववाद की िस्थित उस समय उत्पन्न हुई, जब एजेन्सी द्वारा दुकान का गेट उत्तर की ओर बनाया गया था। Versus Counsel for Petitioner(s) : Brahma Kumar Tiwari, Supriya Mishra Counsel for Respondent(s) : Anand Prakash Paul, C.S.C., Pawan Kumar Singh Shiv Ji Kesharwani .....Petitioner(s) State Of U.P. And 5 Others .....Respondent(s) याची द्वारा गलत िनयत से दुकान के पूवर् की ओर दूसरी दुकान के िलए छोडे गये स्थल की ओर गेट खोलकर अवैध रूप से अपने दुकान का िवस्तार करने की िनयत से प्रयास िकया गया। िजसका ग्रामवािसयों द्वारा िवरोध िकया गया। 8-याची द्वारा पूरब में दरवाज़ा खोले जाने से िववाद की िस्थित उत्पन्न हुई है उत्तर की तरफ दरवाजा बनाये जाने से िकसी को आपित्त नहीं है और न ही मंिदर पिरसर के स्वरूप में कोई पिरवतर्न होगा।" 3. Sri Rajesh Kumar Pal, learned Standing Counsel, has further submitted that in the event the petitioner carries out plaster work and installs the gate towards the northern side, there is no objection from the authority and the petitioner can proceed with it but the only objection is that the petitioner be restrained from extending the shop in the eastern side or to open a gate in that direction. 4. In view of the aforesaid fact, the writ petition is disposed off restraining the respondent authorities from interfering with the petitioner, if the petitioner does the plaster work of the shop and installs a gate towards the northern side. This Court further restrains the petitioner from extending the shop towards the eastern side or from opening any gate in that direction, as he is not authorized for the same.
