Heard Mr. Pramod Kumar Dubey, learned counsel for the petitioners and Mr. Shailendra Singh, learned counsel for the State- respondents. The writ petition has been filed with the following prayer:- "(i) Issue a writ, order or direction in the nature of mandamus directing the respondents to pay salary and other benefits regularly along with arrears and interest to the petitioners w.e.f. 29.05.2016 for the post of Assistant Teacher in Tagore Balika Junior High School, Khutana Bazar, Maharajganj, during the pendency of the present writ petition. (ii) Issue a suitable writ, order or direction in the nature of mandamus commanding the respondents to pay current salary to the petitioners if any when the same falls due admissible to the post of Assistant Teacher. (iii) Issue a writ, order or direction in the nature of mandamus to decide the representation dated 15.04.2025 pending before the respondent no.2. (iv) Issue, any other writ, order or direction as this Hon'ble Court may deem fit and proper in the present circumstances of the case." Learned counsel for the petitioners submits that petitioners were appointed on 09.05.2016 on the post of Assistant Teacher by respondent no.2 in the Institution of respondent no.4. They joined their services on 29.05.2016 but the salary has not been paid. They represented before the respondent no.2 but nothing has been done till date, hence, the present petition has been filed. Learned counsel for the State-respondents could not dispute the aforesaid and submits that in case petitioners move fresh application/representation before the competent authority, the same will be considered and decided in accordance with law. Considering the facts and circumstance of the case but without expressing any opinion on the merits of the case set up on behalf of the petitioners, the present writ petition is disposed of by providing that petitioners may make fresh applications/representations, ventilating all their grievances, supported by such documents, as may be advised, before the respondent no.2 District Basic Education Officer, District Maharajganj, within two weeks from today along with a certified copy of this order. On such representation being made, respondent no.2 shall make all endeavours to consider and decide the same, strictly in accordance with law, by means of a reasoned and speaking order, after giving proper opportunity of hearing to the parties concerned, as expeditiously as possible, preferably within a period of four weeks from the date of production of certified copy of this order, if there is no legal impediment.
