Criminal Petition No.1502 of 2025
ORDER:
This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioners/A4, A5, A8 and A9, seeking regular bail, in Crime No.79 of 2024 of Anantagiri Police Station, Alluri Sitharama Raju district.

A case has been registered against the petitioners herein and others for the offences punishable under Section 111(2)(b) of the Bharatiya Nyaya Sanhita, 2023 (for short ‘the BNS’) and Section 8(c) read with 20(b)(ii)(C), 25 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘the NDPS Act’).
3. Case of the prosecution, in brief, is that, on 22.11.2024, at about 18.00 hours, on receipt of credible information, the Sub- Inspector of Police, Anantagiri Police Station, along with his staff and mediators, while conducting vehicle checking at Arakuvalley to Visakhapatnam main road, in front of Ananthagiri Police Station, found A1 to A11 in possession and illegal transportation of 100 Kgs of ganja in two cars bearing registration Nos.TN 91 D 8708 and TN 05 CM 5169. Police arrested A4 to A6, A8, A9 and

A11 and the contraband along with vehicles and other material was seized from their possession under cover of a mediators report. The other accused escaped from the spot.
4. Heard. Perused the record.
5. A perusal of the material on record goes to show that the contraband allegedly seized from the possession of the accused is 100 Kgs of Ganja, which is a commercial quantity. It is submitted by the learned Assistant Public Prosecutor that the investigation is not yet completed and other accused are to be apprehended. He further submitted that the petitioners herein are involved in similar crimes. This is the second bail application and the earlier bail application filed by the petitioners herein was dismissed by this Court on 20.01.2025. There are no changed circumstances since the dismissal of the previous bail application. In view of the aforesaid facts and circumstances of the case, this Court is not inclined to grant bail to the petitioners/ A4, A5, A8 and A9 at this stage.
6. Accordingly, the Criminal Petition is dismissed.
