ORDER The present revision petition has been preferred seeking quashment or modification of the order dated 11.03.2025 passed in I.A.No.299 of 2022 in HMOP.No.357 of 2021 on the file of the Family Court, Puducherry and for a consequential direction for appropriate procedural safeguards, including specific identification of the articles, appointment of a court officer, and facilitation of locker access for fair implementation of the jewel exchange. 2. The case of the petitioner/husband is that he filed a divorce petition in HMOP.No.357 of 2021 before the Family Court, Puducherry on the ground of cruelty. In the above said HMOP proceedings, the petitioner filed I.A.No.299 of 2022 under Section 151 of C.P.C., seeking return of jewels between the parties. Upon hearing the both sides, the lower court, vide impugned order dated 11.03.2025 allowed the said application and directed the petitioner to return the jewels to the respondent/wife, which are in his custody and also directed the respondent to return the jewels of the petitioner, which are in her custody, within a period of fifteen days. Learned counsel for the petitioner would submit that the jewels are kept in the Bank locker and it is a joint bank locker maintained by both the parties and it is the respondent/wife who is not co-operating to open the locker, enabling the petitioner to return the jewels to the respondent. 4. Per contra, the learned counsel for the respondent states that the respondent/wife is always ready and willing to handover the jewels of the petitioner which are in her custody and at the same time, the petitioner should also return the jewels of the respondent, which is under his custody. Learned counsel further submitted that the respondent is ready to comply with the order of the lower court and is ready to give consent for opening the locker, however, the key is only with the petitioner. 5. On a perusal of the materials available on record, particularly the impugned order, it is seen that the impugned order has been passed based on the consent of the parties on either side and therefore, it is for the parties to co-operate with each other and open the bank locker jointly maintained by them, in order to comply with the impugned consented
order, by returning the jewels with each other. Therefore, this Court is not inclined to interfere with the order impugned.
