ORAL ORDER This petition is filed by the petitioner - defendant aggrieved by the impugned common
order dated 04.03.2024 passed in O.S.No.438/2023 on I.A.Nos.1, 2 and 3 passed by the Principal Civil Judge and JMFC, Devanahalli, which came to be allowed. Aggrieved by the same, the petitioner - defendant has preferred an appeal before the Appellate Court in M.A.No.18/2024, which came to be dismissed confirming the order passed by the Trial Court.
2. The parties shall be referred to as per the status before the trial Court.

3. The plaintiff filed suit against the defendant for the relief of permanent injunction. Along with the plaint, applications were filed under Order XXXIX Rule 1 & 2 of CPC., which was initially granted by way of an ad-interim
order in favour of the plaintiff. Subsequently on appearance of the defendant, the said order came to be modified by the learned trial Judge and an order of status-quo came to be passed, where both the parties were directed not to interfere with each other's properties till disposal of the suit and they were also requested to co-operate with the speedy trial in the suit. This order was taken up to challenge by the defendant before the Appellate Court. On re-consideration of the matter, once again the Appellate Court did not find favour with the defendant. Accordingly, dismissed the appeal and confirmed the order of the trial Court maintaining status- quo by both the parties, which is now the subject matter in this petition.

4. During the course of this petition, the learned counsel for the petitioner-defendant fairly submits that he would not have any objection, if this petition is disposed of directing the parties to continue to maintain the order of status-quo till disposal of the suit and if a direction be given for expeditious disposal of the suit and therefore, considering the submission so made by the learned counsel for the petitioner - defendant, I do not find any need or necessity to issue notice to the respondent - plaintiff as the learned counsel for the petitioner - defendant concedes that the status-quo to be continued and a direction being issued to the trial Court for expeditious disposal of the suit.
5. In view of the submissions made by the learned counsel for petitioner herein, nothing further remains to be deliberated in this petition except for continuation of the
order of status-quo ordered by the trial Court, which is confirmed by the Appellate Court and a direction be issued to the learned trial Judge to expedite the matter.

6. Accordingly, I pass the following;
ORDER (i) This petition is disposed of.
(ii) The interim orders passed by the trial Court as well as the First Appellate Court are sustained.
(iii) The Trial Court is directed to expedite the matter. (iv) The parties shall co-operate for expeditious disposal of the suit.
