1. This is the second bail application filed under Section 483 of the BNSS for grant of regular bail to the applicant who has been arrested in connection with Crime No. 13/2024 registered at Police Station GRP Bilaspur, District - Bilaspur (C.G.), for the offence punishable under Section 20(B) of Narcotic Drugs and Psychotropic Substances Act. 2. The earlier bail application of the applicant being MCRC No. 1920 of 2024 was rejected by this Court vide order dated 12.04.2024 on the ground that the applicant has previous criminal antecedents ABHISHEK SHRIVAS Digitally signed by ABHISHEK SHRIVAS Date: 2025.03.06 16:46:59 +0530
2 under the NDPS Act. 3. Case of the prosecution, in brief, is that on 24.01.2024, the Police has received a secret information from the informant and on the basis of the said information Police seized 10 kgs of Ganja from the possession of the applicant at platform No. 2-3 of Railway Station, Bilaspur. Therefore, the crime has been registered against the applicant. 4. Learned counsel for the applicant submits that, the first bail application of the applicant was rejected by this Court on the ground that the present applicant has criminal antecedent under the NDPS Act with a direction to conclude the trial within a period of 06 months and the applicant is in jail since 25.01.2024 but the trial is not yet been concluded, therefore, he prays for grant of regular bail to the applicant. 5. On the other hand, learned State counsel opposes the bail application of the present applicant and submits that in compliance of this Hon’ble Court’s order dated 24.02.2025, the Director General of Police, Chhattisgarh filed his personal afÏdavit, and directed Superintendent of Police, Rail Raipur (Chhattisgarh) to ensure the compliance of the order passed by the Hon’ble Court dated 03.02.2025, thereafter, in the present case all the prosecution witnesses have been examined and the matter is fixed for recording statement of the accused on 10.03.2025. 6.
6. I have heard learned counsel appearing for the parties and perused the case diary. 7. Considering the facts and circumstances of the case and further the
3 fact that in compliance of this Court’s order dated 24.02.2025, the Director General of Police, Chhattisgarh filed his personal afÏdavit, he directed Superintendent of Police, Rail Raipur (Chhattisgarh) to ensure the compliance of the order passed by this Court dated 03.02.2025, thereafter, in the present case all the prosecution witnesses have been examined and the matter is fixed for recording statement of the accused on 10.03.2025, therefore, I am not inclined to grant bail to the applicant. 8. Accordingly, the second bail application of the applicant – Gopal Singh, filed under Section 483 of the BNSS involved in Crime No. 13/2024 registered at Police Station GRP Bilaspur, District - Bilaspur (C.G.), for the offence punishable under Section 20(B) of Narcotic Drugs and Psychotropic Substances Act, is rejected. 9. OfÏce is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith. - Sd/-
