This intra court Appeal filed by the appellant-University of Kashmir is directed against an interim order dated 03.02.2025 passed by the learned Single Judge of this Court (Writ Court) in WP(C) No.2766/2024 titled “Aaqib Ali Khan Vs. University of Kashmir and Ors.” whereby the writ Court has directed the Principal, Government Medical College, Srinagar and the University of Kashmir, to admit the petitioner for his Second Year Supplementary Examination (MBBS). The order was, however, made subject to the final outcome of the writ petition. 2. During the course of arguments, it was brought to our notice that in compliance to the interim order dated 03.02.2025, the respondent was permitted to sit in the Second Year Supplementary Examination (MBBS) and therefore, the impugned interim order has been complied with. 3. With the aforesaid compliance, this appeal is virtually rendered infructuous and the same is disposed of, accordingly. 4. Since the University of Kashmir, has already filed objections to the maintainability of writ petition, it would be appropriate, if the learned Single Judge takes up the matter for consideration at the earliest, keeping in view the fact that the matter pertains to MBBS examination. Insofar as the consideration of the application filed by the respondent No.1 for declaring the result is concerned, we are of the view, that such an application can only be filed before the learned Single Judge which is seized of the matter. 5.
