BEARING CTP NO. 14693 ON PAROLE FOR THE PERIOD OF 90 DAYS. THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. The petitioner, the wife of the convict – Harish H.B., is before this Court seeking for the following reliefs: "a) Set aside the Parole rejection endorsement dated 24-02-2025 bearing reference no.CPB/CTP-Sec/2146/2024 vide Annexure – B and consequently. b) Pass order / direction by the nature of writ of mandamus to the Respondent No.02 to release the husband of the Petitioner i.e. - 3 - HC-KAR NC: 2025:KHC:49901 WP No. 9160 of 2025 Sri Harish H.B bearing CTP NO.14693 on Parole for the period of 90 days. c) Also grant any additional order / direction that this Hon’ble court may deem fit to grant under the facts and circumstances in the interest of justice and Equity.” 2. The petitioner’s husband had been convicted in S.C.No.184/2011, by the 3rd Additional District and Sessions Judge, Tumakuru, for the offence punishable under Section 307 of IPC and sentenced him to undergo five years imprisonment and to pay fine of Rs.5,000/-. As on 13.03.2025, the petitioner’s husband, convict - Harish H.B. had undergone 7 months 20 days of incarceration. The husband of the petitioner had made an application for grant of parole on the ground of renovation of the residence and that the petitioner, the wife of the convict is unable to carry out the repairs. 3. A memo had been filed on 10.11.2025 stating that the detenue is to be granted emergency parole on account of his mother suffering from medical ailments. A perusal of the medical certificate issued in respect of the health condition of the mother of the convict, which only - 4 - HC-KAR NC: 2025:KHC:49901 WP No. 9160 of 2025 indicates that she is suffering from hypertension with age-related issues. There is nothing in the said certificate that any emergency has arisen requiring to grant emergency parole. 4. The grounds which had been raised by the petitioner have also changed. Firstly, claiming parole on ground of renovation of the house and now claiming on account of health reasons of the mother of the detainee. The same does not inspire any confidence of this Court.
