1. As both the criminal miscellaneous petitions have arisen out of same P.S. case, hence they are taken up and decided together. 2. The petitioners seek regular bail in connection with Gadha P.S. Case No. 35 of 2025, dated 04.06.2025 registered for the offences punishable under Sections 25(1-B)(a), 26 and 35 of the Arms Act. 3. Heard Mr. Sanjay Kumar learned counsel for the
Patna High Court CR. MISC. No.59822 of 2025(2) dt.30-08-2025 2/2 petitioners and Mr. Binod Kumar No.3, learned APP for the State and perused the FIR as well as the trial court's order. 4. Though, from the possession of the petitioner namely Rajnish Kumar, a country made pistol, a live cartridge and a four wheeler vehicle are alleged to have been recovered, however, considering his fair and clean antecedent, his custody period and mainly the fact that the witnesses who are to be examined in the trial of the petitioners are official persons and further the alleged offences are triable by the 1st Class Magistrate and so far as the petitioner namely, Gopal Kumar is concerned from his possession nothing was recovered and he is said to be companion traveller with the co-accused Rajnish Kumar at the time of their arrest, in my opinion, it is a fit case for bail to the petitioners.
Accordingly, let the petitioners named-above be enlarged on bail in connection with Gadha P.S. Case No. 35 of 2025 on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the Court concerned.
