The Criminal Petition, under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is filed on behalf of the petitioner/accused No.13 to grant anticipatory bail in connection with Crime No.50 of 2024 of G.Madugula Police Station, Alluri Sitharama Raju District. 2. A case has been registered against the petitioner/accused No.13 and others for the offences punishable under Sections 20(a)(i) read with 8(b) of the NDPS Act, Section 3 of the P.D.P.P. Act and Section 20 of the A.P. Forest Act. 2 3. Case of the prosecution is that, on receiving credible information about illegal cultivation of Ganja at Degalarai Village hill area, G.Madugula Mandal, Alluri Sitharama Raju District, the S.I. of Police along with his staff proceeded to the cultivating spot. On seeing police, some persons tried to escape from the scene. Immediately Police apprehended them and on questioning them, they revealed the names of the accused persons. 4. Heard. Perused the record. 5. A perusal of the record goes to show that the petitioner along with other accused was allegedly cultivating Ganja at Degalarai Village Hill area. It is alleged that the accused is directly involved in illegal cultivation of Ganja and confessed the same. 6. Learned Assistant Public Prosecutor submits that the investigation is not yet completed. As the alleged offences are considered as social evil and considering the stage of the investigation, this Court is not inclined to grant anticipatory bail to the accused No.13. 7. Accordingly, the Criminal Petition is dismissed. Miscellaneous petitions, if any, pending, shall stand closed. _____________________________ JUSTICE K.
