Kikani, under instructions, states that the petitioner is falling short by 0.5 marks at the time when the merit list and waiting list was prepared. However, according to learned advocate Mr. Kikani, the petitioner is carrying a hope that in case if a second waiting list is prepared, the withdrawal of this petition may not come in his way. Hence, it is clari-ed that in case if the respondent prepares a second merit list, the present withdrawal of the petition shall not come in the way of the petitioner. In view of the above observations made by this Court, learned advocate Mr. S. M. Kikani, under instructions, seeks permission to withdraw this petition. Permission as prayed for is granted.
