RoyBarman, learned Senior counsel assisted by Mr. K. Chakraborty, learned counsel appearing for the petitioner. Also heard Mr. B. Majumder, learned Dy. SGI appearing for the respondents- Union of India as well as Mr. Kohinoor N. Bhattacharya, learned G.A. appearing for the respondents –State. [2] This petition has been filed under Article 226 of the Constitution of India seeking the following reliefs:- “(i) Issue Rule, calling upon the Respondents and each one of them, to show cause as to why a Writ of Certiorari and/or in the nature thereof, shall not be issued, directing them, to transmit the records, lying with them, for rendering substantive and conscionable justice to the Petitioner. and for quashing/setting aside the impugned Notification dated 22.10.2021. (ii) Issue Rule, calling upon the Respondents and each one of them, to show cause as to why a Writ of Mandamus and/or in the nature thereof, shall not be issued. mandating/directing them to grant the benefit of revised pay scale to the Petitioner, in terms of the AICTE Regulations, 2019 w.e.f. 01.01.2016, along with all consequential and financial benefits including arrears thereof; (iii) Call for the records, appertaining to this Writ Petition. (iv) After hearing the parties, be pleased to make the Rule absolute in terms of (i) to (iii) above; (v) Costs of and incidental to this proceeding.” [3] After perusal of the record, it is seen that the petitioner herein submitted a representation dated 12.08.2024 addressed to the concerned respondent(s) ventilating his grievances. But till date the same is pending with the concerned respondent(s). [4] In view of the same, without expressing any opinion on the merits of the case, this present writ petition is disposed of directing the concerned respondent(s) to decide the matter upon the representation dated 12.08.2024 within a period of 02 (two) months from the date of receipt of the copy of this order in accordance with law. [5] With the above observation and direction, this present writ petition stands disposed of. As a sequel, miscellaneous application(s), pending if any, shall stand closed.
