The petitioner is questioning the impugned notice at Annexure ‘A’ dated 02.07.2025 issued by the third respondent-Technical Assistant to the Deputy Director of Land Records, Chikkaballapura District. 3. Learned AGA raises a preliminary objection that a notice issued by a competent authority cannot be questioned before this Court. It is for the petitioner to appear before the competent authority and make submissions to protect the interest of the petitioner. 4. However, learned Counsel for the petitioner points out from the impugned notice that the Assistant Director of Land Records (ADLR) appears to have submitted a report before the Deputy Director of Land Records (DDLR) and the DDLR has accepted the same without issuing prior notice to the petitioner before accepting the report. 5. Having regard to the submissions noticed hereinabove, this Court is of the considered opinion that the third respondent is required to give opportunity of - 4 - HC-KAR NC: 2025:KHC:31609 WP No. 23535 of 2025 hearing to the petitioner before taking a decision or accepting the report submitted by the ADLR. 6. Accordingly, the writ petition stands disposed of while reserving liberty to the petitioner to have his say before the third respondent and the third respondent shall not accept the report of the ADLR without hearing the petitioner. 7. All opportunity as required to be provided under law shall be provided to the petitioner before the third respondent could decide the matter on merits. Ordered accordingly.
