This appeal is directed against the order dated 05.12.2024 passed in M.C.A. Case No.2975/2024, corresponding to A.T.S. P.S. Case No. 04/2024, passed by learned Additional Judicial Commissioner-XVIII-cum-Special Judge, ATS, Ranchi, whereby and whereunder, the prayer for bail of the appellant has been rejected. It has been alleged that the appellant was involved with Roshan Kumar and Awinash Kumar in threatening the Jail Superintendent, Giridih and was planning to attack her and her family members, residing at Deoghar to force her for providing facilities inside the jail to their gang leader, Aman Sao. It has been submitted by the learned counsel for the appellant that he is in custody since 14.07.2024. It has further been submitted that the main allegation is levelled against Roushan Kumar for possessing a mobile, to which, Mrs. Vandana Bharti, learned A.P.P. submitted that the appellant had also issued threats by inserting a different SIM in the said mobile. However, considering the fact that the appellant has been implicated primarily for being a conspirator and the period of custody undergone by him, we, while setting aside the order dated 05.12.20224 passed in M.C.A. Case No. 2975/2024, corresponding to A.T.S. P.S. Case No. 04/2024, passed by learned Additional Judicial Commissioner-XVIII-cum-Special Judge, ATS, Ranchi, direct that the appellant, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Judicial Commissioner-XVIII-cum-Special Judge, ATS, Ranchi, in connection with M.C.A.
