LAKSHMANA RAO CRIMINAL PETITION No:1553/2025 ORDER: The Criminal Petition has been filed under Section 438 of the Code of Criminal Procedure, 1973 (for brevity ‘the Cr.P.C.,’) seeking to enlarge the petitioner on bail in the event of his arrest in Crime No.295 of 2022 of Nallapaedu Police Station, Guntur Urban District under Sections 420 read with 34 of the Indian Penal Code, 1860 (for brevity ‘the I.P.C.’). 2. Heard learned counsel for the petitioner and the learned Assistant Public Prosecutor. Perused the record. 3. As seen from the record there are specific overt acts attributed against the Petitioner, who being the branch manager of the bank, has not displayed a semblance of responsibility and also indulged in creation of fake documents, fake identities and also took percentage of the loan amount while it was given to the beneficiaries. 4. There are no merits in the petition. However, the learned Counsel for the Petitioner requests to grant liberty for the Petitioner to surrender before the learned Judicial Magistrate concerned and move appropriate application. 5. The Petitioner is permitted to surrender before the learned Judicial Magistrate concerned and move appropriate application before the learned Magistrate, who shall dispose of the application on its own merits, in accordance with law within two days, as far as possible. 3 6.
