The Second Appeal is preferred by the appellant against the Judgment and Decree dated 02.08.2006, passed in A.S.No.174 of 2003, on the file of the learned II Additional District Judge, West Godavari District, Eluru.
2. Learned counsel for the appellant submits that the cause of action claimed in the appeal has become infructuous and requests this Court to dismiss this appeal.
3. Recording the above submission and without going into the correctness of the said submission of the learned counsel for the appellant, the Second Appeal is dismissed as infructuous. There shall be no order as to costs.
Interim orders granted earlier, if any, shall stand vacated.
