Hon'ble Salil Kumar Rai,J. Hon'ble Zafeer Ahmad,J. The S.H.O and the S.I of Police Station, Anti Power Theft Thana Mathura, District Mathura are personally present in the Court today. The present writ petition has been filed praying for quashing the First Information Report dated 24.5.2025 arising out of Case Crime No. 2199 of 2025, under section 135 of Indian Electricity Act, Police Station - Anti Power Theft Thana Mathura, District Mathura. It has been stated in the writ petition that on the same offence, Case Crime No.2200 of 2024 has been registered on the same date, therefore, the present F.I.R. is liable to be quashed. It has been argued by the counsel for the petitioner that on the same offence, two different First Information Reports cannot be registered. The A.G.A. and Shri Baleshwar Chaturvedi, Advocate representing the Dakshinanchal Vidyut Vitaran Nigam, Agra have obtained instructions and on the basis of instructions, it has been stated that there were two different illegal connections which were being operated by the petitioner and therefore, two different First Information Reports were registered. The illegal connections were found on inspection on the same date and at the same time. One connection was being used for commercial purposes and the other connection was being used for residential purposes even though the petitioner had a valid connection for residential purposes but still the petitioner was using the separate
illegal connection for residential purposes. It has been stated that the building in which these aforesaid connections were found was used for both commercial and residential purposes in its separate portions.
