This application u/s 528 BNSS has been filed for quashing of the entire proceedings of charge sheet dated 26.10.2024 in Criminal Case No. 7750/2025 (State v. Harikesh Chaubey and others), arising out of Case Crime No. 292/ 2024, under Sections 3(5), 115(2), 125/ 352/ 110 B.N.S., P.S.- Kandhrapur, District- Azamgarh, pending in the court of Additional Judicial Magistrate, Court No.10, Azamgarh. 3. After arguing at some length, learned counsel for the applicant submits that the prayer as made above is not being pressed and applicant is willing to appear before the court concerned and a direction may be made to the court concerned to decide the bail application of applicant expeditiously and in accordance with law laid down in the case of Satender Kumar Antil Vs. Central Bureau of Investigation and another, 2022 SCC OnLine SC 825. 4. In view of the aforesaid, it is directed that in case applicant appears/surrenders before the court concerned within a period of three weeks from today and applies for bail, his bail application shall be considered and decided expeditiously in accordance with settled law. For a period of three weeks from today or till the applicant appears/surrenders before the court concerned, whichever is earlier, no coercive action shall be taken against the applicant in the aforesaid case. 5.
