Today when the matter is taken up, a preliminary objection has been taken by the learned Standing Counsel that against the aforesaid award, statutory alternative remedy is available to the petitioner to file appeal before this Court as provided under Section 30 of the Employee Compensation Act, 1923. 3. At this point of time, a prayer has been made by Sri Shivam Yadav, learned counsel for the petitioner to dismiss the present petition as withdrawn with liberty to file appeal as provided under Section 30 of the Employee Compensation Act, 1923 before this Court. 4. In this view of the matter, the present petition is dismissed as withdrawn with liberty as prayed. 5. Office is directed to return the certified copy of the award after retaining photocopy of the same in the record.
