This criminal miscellaneous petition has been filed at the instance of the petitioners for restoration of ABA No. 889 of 2025 to its original file. Learned counsel for the petitioner submits that the ABA No. 889 of 2025 was rejected as not pressed vide order dated 12.02.2025. Learned counsel for the petitioners submits that as the case could not be marked, hence, the conducting counsel could not appear when the case was called out, which resulted in dismissal of ABA No. 889 of 2025. It is further submitted that the petitioner has very good grounds to agitate in this case and unless the same is restored to its original file, the petitioner will be highly prejudiced. Hence, it is submitted that ABA No. 889 of 2025 be restored to its original file. Learned Addl. P.P. has no serious objection for the prayer for restoration of ABA No. 889 of 2025 to its original file. Considering the aforesaid submission of the learned counsel for the petitioner, ABA No. 889 of 2025 is restored to its original file to the stage, at which, it was before its dismissal.
