ORDER:
THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY CRIMINAL PETITION NO: 1505 OF 2025 This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A1, seeking bail, in Crime No.19/2024 of Donkaral' Police Station, AIIuri Sitharamaraju District. 2. A case has been registered against the petitioner and another for the offence u/Sec.20(b)(ii)(C) r/w 8(c) of the Narcotic Drugs and Psychotropic Substances Act and Section 111 (2) of B.N.S.
3. Case of the prosecution, in brief, isthat, on o7.10.2024 at about 1.00 Pm, On receipt Of Credible information regarding illegal possession and transportation of ganja, the S.I of Police, Donkarai Police Station, along with staff conducted vehicle checking opposl'te to police station and found two Persons coming by holding a Plastic bag. On seeing police, they tried to run away. Then, police apprehended them and on interrogation, they disclosed their identity particulars as that of Al and A2 and police found 22 kgs of ganja in their,-possession. Police seized the contraband, vehicle and arrested the accused and got remanded to judicial custody on o7.10.2024. 4. Heard. Perused the record. 5. Learne-d Assistant Public Prosecutor submits that major part of the investigation is completed except filing of charge sheet due to inventory. _-,`

6. A perusal of the material available on record goes to show that the petitioner/Al was arrested and remanded to judicial custody on o7.10.2024. Police on credible information seized 22 kgs of ganja from the possession of the petitioner and another accused. As stated' by the learned Assistant Public Prosecutor that investigatl'on is completed except filing of charge sheet and as the petitioner is in judicial remand from o7.10.2024 l'.e. more more than 130 days, this Court is inclined to grant the prayer of the petitioner. 7. In view of the aforesaid facts and circumstances of the case, this Court l's inclined to grant bail to the petitioner/Al herein, on the following conditions.
(i) The petitioner/Al herein shall be released on his executing a personal bond for Rs.10,000/-(Rupees ten thousand only) with two sureties for a like sum each to the satl'sfaction of the learned Special Judge for trial of cases under the NDPS Act-Gum-I Additional Sessions Judge, Rajamahendravaram; (ii) On release, the petitioner shall appear before the Station House Officer concerned once in a week i.e. on every Sunday between 10.00 a.m. and 05.00 p.m., till filing of charge sheet. 8.
