The Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 is filed on behalf of the petitioners/accused Nos.3, 5 & 6 seeking regular bail in Crime No.93 of 2024 of Koyyuru Police Station, Alluri Seetharama Raju District. 2 2. A case has been registered against the petitioners herein and others for the offences punishable under Sections 111(2)(b) BNS, 20(b)(ii)(C), 25 read with 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985. 3. Brief facts of the prosecution, in brief, is that, on 29.09.2024 during evening hours, the Sub-Inspector of Police, Koyyuru Police Station along with his personnel and others reached the outskirts of Gudlapalli Village and started conducting vehicle checking; at about 04.00 p.m. he found one auto rickshaw coming from Budaralla Village side and on seeing police, they tried to skulk away, but they were apprehended by police; on enquiry, they disclosed their identity particulars and on search, they were found in possession of Ganja weighing 110 kgs; police seized the contraband under the cover of a Mediators Report and basing on the same, registered a case in Crime No.93 of 2024 for the aforesaid offences, arrested the accused and got remanded them to judicial custody and investigated into the crime. 4. Heard. 5. Learned Assistant Public Prosecutor submits that investigation is not yet completed in this case. 3 6. A perusal of the material on record goes to show that the accused were allegedly found in possession of Ganja weighing 110 Kgs, which falls under commercial quantity. It also appears that the investigation in this case is still in progress. 7.
