[2025:RJ-JP:12149] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 2287/2025 Laxman Singh S/o Parwat Singh, Aged About 37 Years, R/o Khakri, Police Station Garoth, District Mandsaur (M.p.) (Presently Confined In Sub Jail At Ramganj Mandi). ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Rohit Khandelwal For Respondent(s) : Mr. Amit Poonia, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 18/03/2025 1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No. 140/2022 registered at Police Station Suket, District Kota Rural for the offence(s) under Sections 8/15 and 8/18 of NDPS Act. 2. Learned counsel for the petitioner submits that the accused- petitioner has falsely been implicated in this case solely on the basis of disclosure statement of other co-accused Kewal Singh and Sukhdev @ Raju. The recovery of contraband articles containing 97.790KG of poppy straw and 2KG of opium were effected from the possession of other co-accused i.e. Kewal Singh and Sukhedev. There is no substantive evidence against the accused- petitioner substantiating the fact that the petitioner had supplied contraband articles to the other co-accused. The accused petitioner is in custody since long and the trial of the case will take [2025:RJ-JP:12149] (2 of 3) [CRLMB-2287/2025] considerable time, therefore, the benefit of bail may be granted to the accused-petitioner. 3. Per contra, learned Public Prosecutor opposes the bail application and contended that the other co-accused Binder Singh has transferred the amount to the present petitioner. Co-accused Kewal Singh and Sukhdev in their disclosure statement have stated that the contraband articles were supplied by Binder Singh to them, therefore considering the above facts, bail application of the accused-petitioner deserves to be dismissed. 4. Heard and perused the material available on the record. 5. Considering the arguments advanced by the counsel for the parties and looking to the fact that apart from the disclosure statement of other co-accused there is no substantive evidence available on record indicating the involvement of present petitioner in the alleged crime. There is no transaction between the co-accused Sukhdev and Kewal and present petitioner. Accused-petitioner is in custody since long and trial of the case will take considerable time, without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail. 6. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Laxman Singh S/o Parwat Singh, in connection with FIR No. 140/2022 registered at Police Station Suket, District Kota Rural shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before [2025:RJ-JP:12149] (3 of 3) [CRLMB-2287/2025] the court concerned on all the dates of hearing as and when called upon to do so.
