It has been argued by the counsel for the petitioner that the recital in the First Information Report shows that the dispute is essentially civil in nature. The Will referred as a forged document in the First Information Report is a registered Will. The AGA has opposed the petition. In the circumstances of the case and after considering the rival arguments of the counsel for the parties, the writ petition is disposed of with a direction that the petitioners shall not be arrested in pursuance to the First Information Report dated 25.5.2025 registered as Case Crime No.191 of 2025 under Sections 318(4), 352 BNS Police Station Swar, District Rampur till submission of the Police Report under Section 193 of Bhartiya Nyaya Sanhita, 2023.
