Heard Mr. S. Roy, learned counsel for the petitioner, who submits that he may be allowed to withdraw the writ petition and approach the appropriate forum, as his prayer in the writ petition is that a direction should be issued to the respondent authorities to stop the monthly family pension of the deceased Prafulla Kalita, till the Civil Court decides who is the legal heir of the deceased Prafulla Kalita. Mr. P. Saikia, learned counsel appears for the Pension Department, Mr. D. Bhattacharjee, learned counsel appears for the Accountant General, Assam and Mr. P. K.
