The present petition has been filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short-‘BNSS’) by the petitioner for grant of anticipatory bail in case arising out of FIR No.51 dated 20.03.2025, registered under Sections 305 and 61(2) of Bharatiya Nyaya Sanhita, 2023 (for short-‘BNS’), at Police Station Amargarh, District Malerkotla. 2. Status report has been filed by learned State counsel and a copy thereof has been furnished to counsel opposite. 3. Vide order dated 24.06.2025 passed by this Court, the petitioner was granted interim bail and was directed to join investigation. 4. Learned State counsel on instructions from the Investigating Officer, has submitted that the petitioner has joined investigation on NISHA 2025.09.18 11.37 I attest to the accuracy and integrity of this document CRM-M-33184-2025 -2- 12.07.2025 and he is not required for custodial interrogation. 5. Keeping in view the nature of the allegations, pre-trial incarceration of the petitioner is also not required. As such, a case is made out for allowing the present petition. Accordingly, the present petition is allowed and the order dated 24.06.2025, granting interim bail to the petitioner, is made absolute, subject to the conditions laid down in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 (analogous to Section 438(2) of the Code of Criminal Procedure).
