IN THE HIGH COURT OF ORISSA AT CUTTACK CRLMP No. 1255 of 2025 Khetrabasi Jena …. Petitioner Mr. A. Routray, Advocate -versus- State of Odisha & Others …. Opp. Parties Mr. S.J. Mohanty, Addl. P.P. CORAM: THE HON’BLE MR. JUSTICE CHITTARANJAN DASH Order No. ORDER 25.09.2025 01. 1. Heard learned counsel for the Parties. 2. By means of this application, the Petitioner seeks the intervention of this Court for any impartial agency to take up the investigation independently within a stipulated time. 3. It is well settled in law that when a Magistrate issues a direction for registration of an F.I.R. and investigation, the same is to be monitored by the said Court. Any laxity or failure on the part of the Investigating Authority to conduct a fair and diligent investigation is to be brought to the notice of the Court concerned, as the issuance of such a direction does not render the Court functus officio. 4. It is expected that the Petitioner should approach the concerned court for further direction to ensure that a proper investigation is carried out and completed within a stipulated period. 5. Accordingly, the CRLMP stands disposed of. (Chittaranjan Dash) Judge Bijay
