2.
Learned counsel for the petitioners submit that petitioners have falsely been implicated in this case. Learned counsel submit an affidavit has been submitted by the complainant and others wherein, they have stated that petitioner- Bharatsingh was not involved in the incident. Learned counsel for the petitioner- Akash Choudhary submits that an application has already been submitted by the complainant as well as other persons namely, Aryan Khandelwal, Nitin Goyal, Lokesh and Priyanshu to the
[2025:RJ-JP:13908] (3 of 4) [CRLMB-2243/2025] Investigating Officer mentioning therein that they do not want to proceed with the FIR No.55/2025. They argue that trial will take considerable time in its conclusion. They contend that the petitioners, who are young boys, are in custody since 02.02.2025 and further custody of the petitioners would not serve any fruitful purpose.
3. Learned Public Prosecutor opposes the submissions made by counsel for the petitioners. Learned counsel for the complainant does not dispute the affidavit submitted with regard to the petitioner- Bharatsingh.
4. I have considered the contentions.
5. Having regard to the totality of the facts and circumstances of the case; considering the arguments advanced by learned counsel for the petitioners as also looking to the material available in the case diary; also considering the nature of dispute and trial will take time in its conclusion as well as looking to the period of custody, but without commenting anything on the merits/demerits of the case, I deem it fit and proper to allow these bail applications.
