This is a Criminal Writ Petition filed under Article 226/227 of the Constitution of India for the issuance of a writ in the nature of certiorari for quashing the order dated 19.06.2025 (Annexure P-1) passed by respondent No.2 declining the grant of emergency parole to attend the kriya ceremony of brother of the petitioner. 2. Learned counsel for the petitioner has submitted that the brother of the petitioner had died on 14.06.2025 and the kriya ceremony is to take place on 28.06.2025 at Village Dhani Bhodia Bishnoian Police Station Adampur, District Hisar. It is submitted that at any rate, the petitioner is entitled to attend the said kriya ceremony in custody even in case the emergency parole of 16 days is not allowed to the petitioner. Learned State Counsel has very fairly submitted that the petitioner could only be permitted to attend the kriya ceremony for the period of maximum 6 hours which would exclude the period taken for journey. 4. Keeping in view the abovesaid facts and circumstances and the limited prayer made by learned counsel for the petitioner, the present Criminal Writ Petition is disposed of in the following terms:- i) The Superintendent of Police, Bhiwani is directed to arrange for the petitioner to be taken in custody from 09:00 am on 28.06.2025 to Village Dhani Bhodia Bishnoian Police Station Adampur, District Hisar where kriya ceremony of brother of the petitioner is to be performed and also to arrange for the petitioner to be brought back to jail on same day i.e., 28.06.2025. Return journey would start at 4 pm.
