The instant writ petition is filed seeking mandamus directing upon the respondent no.5 to pass an order of hearing taken placed on 7th January, 2025. Chequered history of the matter is that one Chintamoni Sarkar approached this Court vide WPA 26768 of 2024 asking necessary direction. Having heard the said petitioner this Court vide order dated 28th November, 2024 has directed the concerned authority to dispose of the application of Chintamoni Sarkar and Jaba Bala Sarkar (petitioner) by giving them reasonable opportunity of being heard. It appears from the Annexure P-8 of the writ petition that a notice of hearing was served upon the petitioner. The date was fixed for hearing
on 7th January, 2025. Ms. Mukherjee, learned counsel led by Ms. Sonal Sinha, learned counsel on behalf of the State respondents submits that the concerned authority has already passed an order on 28th January, 2025. Copy of the order dated 28th January, 2025 is placed before this Court and the same is taken on record. Hearing the learned counsel for the State respondents and also considering the fact that the impugned order has already been passed, this Court is of the opinion that the instant writ petition become infructuous. Accordingly, the instant writ petition is hereby disposed of as infructuous. Urgent photostat certified copy of this order, if applied for, be given to the learned Advocates for the parties on the usual undertakings. (Subhendu Samanta, J.) 2
