When the case is listed and called out, the advocate must be present. The absence may affect the case. Smt.H.R.Renuka., counsel for the respondent has appeared in person. As could be seen from the daily order sheet, the petition was listed on 12.11.2025, on that day, though matter called twice, there was no representation on behalf of the petitioner, either personally or through video conferencing. Hence, for appearance of counsel for the petitioner, it was ordered to be listed on 19.11.2025. It was also ordered that if none appears for the petitioner on the next date of hearing, the petition will be dismissed for non-prosecution. The petition is listed today. As already noted above, though matter called twice, the petitioner is not represented. As could be seen from the Writ papers, the petition is filed in 2020. Now we are in November, 2025. The petition is pending from five years. It appears that the petitioner is not interested in prosecuting the petition. In view of peremptory order dated - 3 - HC-KAR NC: 2025:KHC:47632 WP No. 5488 of 2020 12.11.2025, the Writ Petition is dismissed for non- prosecution.
