It is contended that the Tribunal while disposing the matter vide impugned judgment dated 26.11.2022, though allowed right of recovery as against Owner- Respondent No.6, but this Court while disposing the appeal, has not confirmed the right of recovery as against Respondent No.6. 5. Considering the submissions and after going through the impugned judgment, since it is found that right of recovery was there against owner-Respondent No.6, this Court in addition to the direction contained in order dated 13.02.2025, also confirm right of recovery so allowed by the Tribunal as against Owner-Respondent No.6.
