JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 2 18-09-2025 Heard learned counsel for the petitioner and learned APP for the State. 2. The petitioner seeks regular bail in connection with Madhepur Prohibition/Excise P.S. Case No. 185 of 2025 for the offences registered under Section 30(a) of the Bihar Prohibition & Excise Act. 3. On getting secret information regarding transportation of illicit liquor on a Tempo, police party reached at the marked place. Seeing the police party petitioner and co- accused tried to flee away but on chase they were apprehended. On search, 140 litre country made liquor was recovered from the said Tempo. 4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this Patna High Court CR. MISC. No.60889 of 2025(2) dt.18-09-2025 2/2 case. Petitioner is neither driver nor owner of the said tempo. He was sitting on the said Tempo as a passenger. He had no knowledge about the seized liquor, kept in the Tempo. Petitioner has no concern either with the seized liquor or with the co- accused person. Nothing has been recovered from the conscious possession of the petitioner. Charge-sheet has already been submitted after completion of investigation. Petitioner has no criminal antecedent. Petitioner is in custody since 20.07.2025. Petitioner undertakes to co-operate in the trial. 5. Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner. 6. Considering the submissions made on behalf of the parties and facts and circumstances of the case, let the petitioner, named above, be enlarged on bail upon furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge VII-cum-Special Judge Excise-II, Madhepura in connection with Madhepura Prohibition/ Excise P.S.
