In view of the order proposed to be passed herein, no useful purpose would be served by putting the opposite party to notice and keeping this petition pending before this Court. However, in case the opposite party feels aggrieved by the order his/her right to seek modification/variation of the order is being kept reserved. 3. The basic relief sought by the petitioner in the present petition is to direct the Commissioner Gorakhpur Division, Gorakhpur to decide the Appeal No. C202005000001166 (Syed Ahmed Tahir Ali Vs. Chief Revenue Officer, Gorakhpur) arising out of Ceiling Case No. 00857 of 2020 (State Vs. Syed Ahmed Tahir Ali) under Section 10(2) of U.P. Imposition of Ceiling of Land Holdings Act, 1960 preferred against the order dated 28.10.2020 and 29.10.2020 passed by Chief Revenue Officer, Gorakhpur/Prescribed Authority (Ceiling), expeditiously. 4. The matter is pending before the Court below since long and considerable time has already been lapsed but till date no final decision has been taken in the matter. 5. In the facts and circumstances of the case, the present petition is disposed of directing the Commissioner Gorakhpur Division, Gorakhpur to decide the aforesaid appeal strictly in accordance with law most expeditiously and preferably within a period of four months from the date of production of certified copy before the Court below but without granting unnecessary adjournment unless there is no legal impediment.
