THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MRS. JUSTICE ANU SIVARAMAN and HON'BLE MR. JUSTICE VIJAYKUMAR A. PATIL - 3 - HC-KAR NC: 2025:KHC:54305-DB C.C.C. No.860/2024 ORAL ORDER (PER: HON'BLE MR. JUSTICE VIJAYKUMAR A. PATIL) This contempt petition is filed alleging willful disobedience of the order dated 11.08.2023 passed by the learned Single Judge in W.P.No.38468/2014 (S-R). The operative portion of the said order at paragraph No.7 reads as under: "7. In this view of the matter, since the petitioner was promoted on 16.06.2003, he automatically becomes entitled to his normal increment in the higher pay scale on 01.01.2004 and consequently, the petitioner would be entitled to have a re-fixed pay scale by granting him an additional increment which fell due on 01.01.2004. The respondent shall ensure that the pay scale of the petitioner is re-fixed as stated above and pay him the benefits within a period of three months from the date of receipt of a copy of this order." 2. The respondent entered appearance and filed compliance affidavit. Paragraph No.3 of the said affidavit reads as under: "3. I respectfully submit that the office of the Principal Accountant General (A & E), Karnataka is the competent authority to implement the impugned order of this Hon'ble Court dated 11.08.2023. Accordingly, the Senior Accounts Officer/PV14, office of the Principal Accountant General (A & E), Karnataka, Indian Audit and Accounts Department, Bengaluru was requested to take necessary - 4 - HC-KAR NC: 2025:KHC:54305-DB C.C.C. No.860/2024 action to implement the Judgment passed by this Hon'ble Court in the above said Writ Petition vide Government Letter No.LAW-LAC/216/2023 dated 03.10.2024. Accordingly, vide letter No.PV14/2/1524404992/2500138601/453492/453492 B, dated 21.11.2024, the pension and pensionary benefits of Sri Basavarajappa N.R., were revised and the copy of the same is produced as ANNEXURE-'R1'." 3. The aforesaid affidavit and the Annexure-R1 produced along with the said affidavit indicate that re- fixation of pensionary benefits of the complainant is done as per the directions of the learned Single Judge. Hence, the contempt proceedings are dropped. Liberty is reserved to the complainant to seek appropriate remedy, if the grievance still subsists, in accordance with law.
