Issue appropriate writ, order or direction commanding the respondents to take appropriate action for execution of final decree dated 5.05.2016 passed by the Sub-Divisional Magistrate/Assistant Collector, Auraiya passed in Case No. 41/2005-06/D-200503050019 (Vinod Chandra vs. Deshdipak and others) under section 176 UPZA&LR Act and further ensure the actual physical possession over Gata Nos. 287/4 area 0.272 hectare, 177/2 area 0.500 hectare, 310/4 area 0.767 hectare, 311 area 0.016 hectare and 325/2 area 0.176 hectare situated at Mauja-Samrathpur, Pargana and District-Auraiya. B. Issue an appropriate writ, order or direction commanding the respondents to take appropriate action/decision in light of petitioner's pending representation dated 28.02.2025 sent through registered post forthwith 12.03.2025." According to the pleadings made in the writ petition, it transpires that final partition decree was made in the year 2016. The petitioner had sent an application to the Sub-Divisional Officer for getting the decree executed which is pending. As no useful purpose would be served in keeping the matter pending, or calling for counter affidavit, the matter is being disposed of, at the admission stage, with a direction upon respondent no.3 to take up the application moved by the petitioner and get the decree executed, if there is no legal impediment, after hearing all the concerned parties, strictly in accordance with law expeditiously preferably within a period of four months from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
