Applicant Kuldeep Singh @ K.D. is in judicial custody in FIR No. 649 of 2012 under Sections 147, 148, 149, 307, 302, 120B, 34 and 174A IPC, P.S. Kashipur, District Udham Singh Nagar. He has sought his release on bail. 2. This is eighth bail application of the applicant. His first bail application was dismissed as withdrawn on 18.11.2014, his second bail application was dismissed in want of prosecution on 01.06.2016, he was granted short term bail for a period of four weeks in his third bail application on 27.06.2017, and the fourth, fifth and sixth bail application of the applicant were rejected on 17.06.2022, 03.03.2023, and 20.03.2024, respectively. The seventh bail application of the applicant was disposed of on 11.12.2024 by treating the same as short term bail application. 3. Heard learned counsel for the parties and perused the record. 4. At the very outset, learned counsel for the applicant, after arguing at some length, submitted that this application may be treated as short term bail application. He submits that the applicant is a patient of Haemorrhoids Grade III; he was granted short term bail for
2 undergoing operation, which was extended also; he was treated, but still the problem persists. 5. Admittedly, on 11.12.2024, having considered the medical condition of the applicant, he was granted short term bail, when it was told to the Court that the applicant wants to be operated and he is also suffering from tuberculosis. 6. Learned State Counsel admits that the applicant was unwell and he was granted short term bail. 7. Having considered, without adverting further on the merits of the case, purely on the humanitarian ground, this Court is of the view that the applicant may be granted short term bail for a period of eight weeks from the date of his release. 8. The applicant is granted short term for a period of eight weeks from the date of his actual release, subject to his executing a personal bond and furnishing two reliable sureties, each of the like amount to the satisfaction of the court concerned.
It is further directed that on expiry of period of short term bail, the applicant shall surrender before the court concerned and intimation to this effect shall also be given to this Court. In case the applicant undergoes operation, he would submit all the valid documents. 9. The 8th bail application stands disposed of accordingly. (Ravindra Maithani, J)
