The petitioner had preferred a revision before the Additional Commissioner, Consolidation and Settlement, Sambalpur being R.P. Case No.70 of 2021. On the date of hearing, i.e., on 13.04.2023 neither the petitioner nor his advocate was present. The revisional Court, instead of dropping the case for default passed an order on the merits rejecting the revision. 3. Mr. Chhatoi, learned counsel appearing for the petitioner submits that reliance upon certain circulars as well as the order of this Court passed in an earlier writ application by the revisional authority was not in the proper perspective. Further, the relevant statutory provisions had not been considered. 4. Since the statute provides the remedy of revision where all these aspects can be considered and this is a case where the petitioner, for whatever reason, did not participate in the hearing, Laba Kishore Patra .… Petitioner Represented by Mr. P.R. Patnaik, Additional Government Advocate Order No. 01. . this Court is of the view that it would be better if the matter is heard afresh to consider all the contentions of the petitioner. 5. The writ application is therefore, disposed of by setting aside the impugned order and by remitting the matter to the revisional Court for hearing of the revision afresh after granting opportunity of hearing to the petitioner. In order to cut short the delay, the petitioner is directed to appear before the revisional Court along with the certified copy of this order on 27th January, 2026 for fixing date of hearing of the revision petition by the revisional Court. 6. It is made clear that this Court has not expressed any opinion on the merits of the Case. 7. Urgent certified copy of this order be granted on proper application.
