Petitioner Sachin Kumar has filed petition under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of anticipatory bail in case FIR No. 191 dated 24.05.2025 under Section 115, 74 of BNS, 2023 (P-1) registered at Police Station Thana Sadar, District Yamuna Nagar. 2. Learned counsel for petitioner pointed out that petitioner has already joined investigation and fully cooperated with Investigating Agen- cy. He is still ready to abide by terms and conditions of bail order. 3. In the case in hand, petitioner was granted interim bail by the Coordinate Bench vide order dated 23.06.2025, relevant part of which runs as under :- LALIT SHARMA 2025.09.18 13:22 I attest to the accuracy and integrity of this document CRM-M-33097-2025 -2- “xxxx xxxx In the meantime, the petitioner is directed to appear before the SHO/Investigating Officer as and when called upon to join in- vestigation and in the event of arrest, he shall be released on interim bail on his furnishing bail bonds to the satisfaction of SHO/ Investigating Agency, subject to the following conditions as envisaged under Section 482(2) of the BNSS:- i) that the petitioner shall make himself available for interroga- tion as and when required; ii) that the petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him / her from disclosing such facts to the Court or to any police officer; iii) that the petitioner shall not leave India without the prior permission of the Court.” In pursuance of aforesaid order, learned counsel representing State confirmed that petitioner has already joined investigation and he is not required for any other purpose. 4. Today, nobody has appeared on behalf of complainant. 5. In the light of aforesaid factual position, no purpose would be served by sending petitioner behind the bars since he has already joined in- vestigation and cooperated with Investigating Agency. Therefore, anticipa- tory bail petition filed by petitioner Sachin Kumar is allowed and interim bail already granted in his favour vide order dated 23.06.2025 is confirmed, subject to the same terms and conditions envisaged under Section 482(2) of BNSS, 2023. 6.
