SONI SHRIVASTAVA ORAL ORDER 2 12-09-2025 Heard Mr. Pushkar Narain Shahi, learned senior counsel, assisted by Mr. Madhukar Anand, for the petitioners and learned APP for the State. 2. The petitioners seek bail in a case registered for the offence punishable under Sections 25 (1-b)(a), 26 and 35 of the Arms Act. 3. It appears that by a detailed order dated 25.07.2025 passed in Cr. Misc. No.37317 of 2025 along with two analogous cases, the prayer for bail of the petitioners had been rejected with a liberty to renew their prayer for bail after framing of charge. 4. Learned senior counsel for the petitioners, besides submitting that there is no recovery from the physical and conscious possession of the petitioners and the mandatory provisions of search and seizure have been violated, also points out that now the charges have been framed on 05.08.2025. It is further submitted that other similarly situated co-accused persons had already been granted privilege of bail vide Annexure-3 to this application. 5. Taking into consideration the facts and circumstances of the case as also the fact that the prayer of the Patna High Court CR. MISC. No.59523 of 2025(2) dt.12-09-2025 3/3 petitioners had earlier been rejected with liberty to renew their prayer for bail after framing of charge and charges have now been framed, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Munger Muffasil P.S.
