(ORDER) 21.04.2025 01. By virtue of an order dated 25.03.2025, this court came to dismiss the appeal on ground of repeated non-appearance of the counsel for the appellant. 02. The dismissal of the case had taken place in presence of counsel for the respondent and, as such, even though the application for restoration is within time still without putting the other side to the notice, indulgence in the present application cannot be granted ex- parte. 03. Issue notice to the non-applicant/ respondent. 04. Applicant to furnish registered postal cover before the Registrar Judicial, Srinagar within a period of seven days whereupon notice to go to the non-applicant/respondent for appearance in the case. 05. List on 21th of May, 2025. 06. In the meantime, status quo is directed to be maintained by the parties. 07. This order is, however, subject to objections from the other side. 08. It is made clear that in the event of non-appearance of counsel for applicant/ petitioner on the next date of hearing, this direction shall stand vacated without any express order to this effect.
