This petition is filed by accused No.3 under Section 483 of BNSS praying to grant bail in Crime No.123/2025 of Kaggalipura Police Station registered for the offences punishable under Section 140(1), 140(2), 142 and 311 of BNS, 2023 pending in CC No.6063/2025 on the file of II Additional Chief Judicial Magistrate, Bengaluru Rural District, Bengaluru. 2. Heard learned counsel for petitioner and learned Additional SPP for respondent/State. 3. Learned counsel for petitioner would contend that one Siddaraju brother of accused No.1 had contact with the victim with regard to some real estate. There might be some dispute between Siddaraju and victim Rajasekhar, due to which, a false case might be filed against accused

No.1, the brother of Siddaraju and others. The statement of the victim indicates that he ran away from the clutches of the accused persons. The charge sheet has been filed. Therefore, the petitioner is not required for custodial interrogation. With this, he prayed to allow the petition. 4. Per contra, learned Additional SPP would contend that the offence alleged against the petitioner is a heinous offence of kidnapping for ransom. There is recovery of 2 knives, machete, 3 masks, ATM card of victim, cash of Rs.39,000/- and a car belonging to brother of this petitioner. Petitioner is having criminal antecedents. If the petitioner is granted bail, there are chances of him tampering the prosecution witnesses and committing similar offence. With this, he prayed for rejection of the petition. 5. Having heard the learned counsel, the Court has perused charge sheet records and other materials placed on record. - 4 -

The accusation against accused Nos.1 to 4 is that they kidnapped CW.2 Rajashekar in Maruthi Swift Car bearing registration No.KA-03-AF-8142 by showing a knife and at the time of kidnap when CW.1 came to protect CW.2, accused No.1 showed knife to CW.1 and threatened her. The accused persons took CW.2 and demanded Rs.1 Crore or otherwise to kill him. The accused persons made a phone call to CW.3 and asked him to arrange money and gave him life threat. The accused persons snatched ATM card of CW.2 and forcibly took pin and drawn money from the ATM through this petitioner/Accused No.3. 7.
The victim after arrest of the accused Nos.1 to 3 has identified them. The offence alleged against the petitioner and other accused is kidnapping for ransom and it is a heinous offence. There is recovery of two knives, machete, three masks, ATM card of victim and cash of Rs.39,000/- and car at the instance of accused Nos.1 to 3. Accused No.4 is still absconding. Considering all these aspects, there is a prima-facie case against the petitioner

for offences alleged against him. The petitioner has not made out any grounds for grant of bail. As submitted by learned Addl.SPP, there are criminal antecedents of this petitioner.
