Neutral Citation No. - 2025:AHC:105660-DB Court No. - 40 Case :- WRIT - C No. - 20879 of 2025 Petitioner :- Oriental Handloom Silk Cooperative Society Ltd. Respondent :- Union Of India And 5 Others Counsel for Petitioner :- Nikhil Kumar,Vagish Yadav Counsel for Respondent :- A.S.G.I. Hon'ble Ashwani Kumar Mishra,J. Hon'ble Jayant Banerji,J. Heard learned counsel for the petitioner and Sri Purnendu Kumar Singh, learned counsel for the respondents. Petitioner has approached this Court for a direction upon the respondents to hold an inquiry into constitution, working and financial condition of the third respondent which is a multi State cooperative society. Prayers are also made for appropriate inquiry against the office bearers of third respondent society arrayed as respondent nos.4 to 6. A preliminary objection is taken to the maintainability of the writ petition on the ground that no part of cause of action has arisen within the territorial limits of this Court. Admittedly, the third respondent society is registered at New Delhi. In the writ petition it is not shown that any part of cause of action in respect of the third respondent society has arisen within the territorial limits of this Court. The only circumstance which is relied upon by the petitioner to create jurisdiction with this Court is that petitioner's society is registered at Varanasi. It is alleged that certain supplies have been made by the petitioner to the third respondent but payments have not been released. From the materials placed on record, we do not find that any part of cause of action has arisen within the territorial limits of this Court. Therefore, the writ petition itself would not be maintainable. The remedy of the petitioner would be to approach the competent forum. Writ petition is, accordingly, consigned to records.
